Procedure for connecting Internet service providers to Gateway Internet Access Services (GIAS)

 

All ISPs are required to obtain ISP booklet containing application form for each location of connectivity. This booklet can be obtained by paying Demand Draft of Rs. 1000/- in favor of "Videsh Sanchar Nigam Ltd" .

1.       Based on their requirements, ISPs are required to obtain local leads from DOT/MTNL till VSNL gateway locations at Mumbai, Chennai, Bangalore, Calcutta, New Delhi, Pune, Ernakulam, Jallundhar and Hyderabad.

2.       ISPs are also required to duly submit the application form available in ISP booklet along with License copy and payment (installation, registration and first quarter installment) to Videsh Sanchar Nigam Ltd.

3.       ISPs are required to obtain IP addresses from agencies such as APNIC and register their domain with NCST, Mumbai or Internic. The details of IP addresses management are provided in this document.

LICENSING DETAILS (No.845-51/97-VAS)

1. The Registered Indian Companies can provide Internet Service on a license on non-exclusive basis.

2. General and commercial information

Eligibility criteria

This invitation is open to any Indian Registered Company. A Company registered in India under the Companies Act, 1956 will be eligible to submit proposal. License to run the service will be issued to the proposed company if found eligible and complies with all the requirements laid down in the application form. Foreign equity, if any, shall be as per the Government policy and guidelines from time to time. At present, the foreign equity is permitted to the extent of 49%.

There is no requirement of the Applicant Company having any prior experience in information technology or telecommunication services.

Service area

Separate licenses shall be granted to any applicant company for each service area. For this purpose, the country has been divided into separate service areas in three categories as mentioned below: -

(i) Category "A" – This covers the territorial jurisdiction of the Union of India except specified areas that may be notified to be excluded from time to time.

(ii) Category "B" – Any of the 20 Territorial Telecom Circles, four Metro Telephone Districts of Delhi, Mumbai, Calcutta or Chennai and four major telephone districts of Ahmedabad, Bangalore, Hyderabad or Pune are Category ‘B’ Service areas. The four Metro Telephone Districts (Delhi, Mumbai, Calcutta & Chennai) are not part of any Telecom Circle, whereas the four major Telephone Districts (Ahmedabad, Bangalore, Hyderabad & Pune) are part of respective Telecom Circle.

(iii) Category "C" – Any Secondary Switching Area (SSA) of DOT with geographical boundaries as on 1.4.98, will form a separate category "C" Service Area with the exception that each of the four Metro telephone Districts of Delhi, Mumbai, Calcutta & Chennai and of four major Telephone Districts of Ahmedabad, Bangalore, Hyderabad & Pune of the DOT/MTNL with geographical boundaries as on 1.4.98, will form a separate Category ‘B’ service area.

Applicants will be required to submit separate application for each service area. The ISP will be required to set up his nodes i.e., Routes/servers within the geographical limits of the service area. An applicant company may be granted any number of licenses. Also, there shall be no limit on number of licenses that can be granted in a particular service area. The leased line subscribers shall be from within the service area. However, the ISP can offer dial up service from any part of the country.

Existing e-mail and VSAT Service Licensees may also obtain separate ISP License for any number of the above mentioned service areas subject to fulfillment of eligibility criteria.

Validity of the application

Each proposal shall be valid for a minimum period of six months from the date of application.

Processing fee

The proposed shall enclose a DEMAND DRAFT for Rs. 5,000/- (Rupees FIVE Thousand only) in favour of Pay & Accounts Officer, Headquarters, Department of Telecommunications, Sanchar Bhavan, New Delhi-110 001 in respect of each service area, separately with each application towards processing fee. The processing fee is not refundable.

Issue of license

Separate license will be issued for each service area proposed, under relevant provisions of Indian Telegraph Act, 1885, Indian Wireless Telegraphy Act 1933 and TRAI Act 1997 and the licensee shall abide by the provisions of the said Acts and the rules made thereunder.

Interconnection with other networks

Direct interconnectivity between two separately licensed ISPs shall be permitted. Authorised Public/Government organisations will be allowed to provide INTERNET Gateway access including international leased circuits directly without going through VSNL Gateways. Private ISPs are allowed to provide such International Gateways after obtaining Security clearance for which the Interface of Private ISPs shall only be with the Telecom Authority.

The licensee may obtain the transmission link on lease from DOT, Licensed Basic Service Operators, Railways, State Electricity Boards, National Power Grid Corporation or any other operator specially authorised to lease such lines to the ISPs. The licensee may also establish its own transmission links within its service area for carrying traffic originated and terminated by his subscribers, provided that such capacities are not available from any other authorised agencies and subject to permission of Telecom Authority.

An ISP may provide Internet Service to any VSAT subscriber (who could be served by a shared hub commercial service provider or captive private VSAT network), if the VSAT is located within the service area of the ISP. For this purpose, a direct interconnection of VSAT or VSAT-hub through leased line obtained from an authorised provider to the ISP’s node/server shall be permitted only for the flow of Internet traffic. The existing license for Closed Users Group Domestic 64 KBPS Data Network via INSAT Satellite Systems does not grant long distance carrier rights to the licensee. The ISP shall provide to the Telecom Authority a monthly statement of VSAT subscribers served with their locations and details of leased line interconnection with the VSAT hub. The VSAT hub, however, need not be located in the service area of the ISP.

Resources required for interconnecting the licensee’s network to the network of upstream internet access providers (DOT/VSNL etc.) or any other service provider licensed by the Authority including time frame for provision of the same, will be mutually agreed between the parties concerned. The resources may refer to include but not limited to physical junctions, PCM derived channels, private wires, leased lines, data circuits other network elements. The licensee shall apply for and obtain the network resources from the concerned parties. The tariff of such network is outside the scope of this license agreement. Licensor will have no obligation for such resources from other parties.

Delivery of the service

The LICENSEE shall be responsible for installation, testing and commissioning of all the equipment to provide the SERVICE including connectivity to DIAS or GIAS or authorised public/Government Organisations for delivery of Internet traffic.

The licensee shall provide service within 18 months from the date of signing of the license agreement. Commissioning of service will mean providing commercial service to customers.

Extension of license

The validity of license is initially for a period of fifteen years unless otherwise terminated. If requested by the licensee, the TELECOM AUTHORITY may grant extension on suitable terms and conditions for a period of five years or more at a time.

The decision of the TELECOM AUTHORITY shall be final in this regard.

 

Technical requirements

Private ISPs shall use IP (Internet Protocol) and shall meet the technical requirements of the Internet Service Providers (DOT/MTNL/VSNL/other ISPs) to which it is connected. The equipment used by the Private ISP shall be in conformance with the Interface/Protocol requirements as applicable of the service provider. Some of the interfaces required are given below: -

Quality of service

The quality of service over Internet is not established and defined as yet. As such, the QUALITY OF SERVICE is not being defined for the time being. However, it may be defined at a later date based on the experience gained and inputs from the Internet Engineering Task Force (IETF).

Telephony on the Internet

Telephony on the Internet is not permitted. The license will be liable for termination for any violation of this clause of the License Agreement. The licensee shall also take measures on his own and as and when directed by the Government at his own cost to bar carriage of Telephone Traffic over Internet.

Obscene material and applicability of cyber laws

Flow of obscene, objectionable, unauthorised or any other content infringing copy-rights, intellectual property right and international & domestic Cyber laws in any form over the ISP’s network is not permitted and the ISP is supposed to take such measures as to prevent it. Any damages/claim arising out of default on the part of the licensee in this respect shall be the sole responsibility of the licensee.

IP address, domain name

It will be the responsibility of the licensee to obtain IP address, domain name etc. from the competent authority. In case the IP addresses are taken from the Department of Telecommunications, the same are non-portable and have to be returned to DOT at the termination of connectivity contract.

 

 

Financial conditions

Quantum of license fee and schedule of payments

(i)The Telecom Authority has decided to waive the License Fee for a period up to 31.10.2003. For those ISPs also who obtain licenses prior to 01.11.2003, a nominal license fee of One Rupee per annum will become payable from 01.11.2003.

(ii) For access and other charges including MODEM charges payable to the DOT/ MTNL/VSNL/other service provider at the prescribed rates, bills will be raised directly by the DOT/MTNL/VSNL/other service provider and shall be a matter between the Licensee and such service provider(s).

Performance Bank Guarantee (PBG)

A performance bank guarantee of Rs. 2.00 crores for category ‘A’ Service Area, Rs. 20.00 lakhs for each category ‘B’ Service Area and Rs. 3.00 lakhs for each category ‘C’ Service Area valid for two years from any Scheduled Bank in the prescribed form (Schedule ‘D’ of the draft License Agreement) shall be submitted alongwith the application for each service area. The licensee will be liable to extend the validity of Performance Bank Guarantee two months prior to its date of expiry on its own without demand from the Licensor for a further period of one year on year to year basis. On any failure to do so, the performance bank guarantee will be encashed without giving any notice. This is without prejudice to any other action that may be taken under the terms and conditions of the license.

Tariff

ISPs will be free to fix their own tariff. The tariff shall be left open to be decided by market forces. However, the TRAI may review and fix a tariff at any time during the validity of the license, which shall be binding on the Licensee.

Internet Service Providers would have option to pay charges in advance or four equal quarterly installments.

Internet Service Providers will be responsible for providing link between their premises and VSNL nearest gateway as per policy guidelines specified by Govt. of India from time to time.

Leased line applications should be accompanied with request on letterhead and copy of license.

Broad Terms and Conditions of GIAS Subscription

VSNL shall update Gateway Internet Access Services (GIAS) without prior intimation to its subscribers.

The subscriber is required to use Telecom Engineering Centre (TEC), New Delhi approved Interface Equipment for accessing Gateway Internet Access Services. In case where it is necessary to pay License Fee to Department of Telecommunications/MTNL for connecting Modem/other Interface equipment etc. to PSTN, subscriber is required to complete necessary formalities with local DOT/MTNL office.

 

All Gateway Internet Nodes Madras, New Delhi, Calcutta, Mumbai, Bangalore and Pune are interconnected with high-speed links  provided by Department of Telecommunications. The International connectivity is provided via satellite from USA to all GIAS Nodes. VSNL would try to maintain these links as reliable as possible. However, it would own no responsibility in case of interruptions in the network beyond its reasonable control.

     

VSNL would try to upgrade Network capacity so as to provide desired speed of connections to the subscribers. However the subscriber understands that he would be able to operate at the desired speed only for 50 % of time.

 

The subscriber of Gateway Internet Access Services will be able to resale the Internet Services as per terms and conditions specified in their License.

 

The subscriber understands that interactive voice and fax messaging shall not be permitted on GIAS. The subscriber undertakes not be involved in selling/promoting Internet Telephony/Fax etc., which are absolutely prohibited. Upon a breach by subscriber of this undertaking VSNL shall have the right to terminate this Agreement without any notice.

 

The subscriber understands that the software supplied by VSNL is copyright protected and copying of the same is liable to attract legal action under copyright Act.

 

The subscriber is required to desist from sending unsolicited messaging via Gateway Internet Access Services.

 

The subscriber is required to fully comply the provisions of the Indian Telegraph Act, 1885, and the Indian Telegraph Rules made thereunder and any amendments or replacements made thereto from time to time.

 

The subscriber is required to ensure that objectionable or obscene messages or communications, which are inconsistent with the established laws of the country, are not made by him or any other person using his password.

 

VSNL may revise the tariff for Gateway Internet Access Services from time to time at its discretion.

 

Customer assumes total responsibility and risk for use of the Gateway Internet Access Services. Neither VSNL nor its affiliates make any express or implied warranties, representations or endorsements whatsoever (including without limitation warranties of title or non-infringement, or the implied warranties of merchantability or fitness for a particular purpose) with regard to any merchandise, information or service provided through the Internet, and they shall not be liable for any cost or damage arising either directly or indirectly from any such transaction. It is solely customer’s responsibility to evaluate the accuracy, completeness and usefulness of all opinions, advice, services and other information, and the quality and merchantability of all merchandise, provided through the service or in the Internet generally.

 

Customer understands further that the Internet contains unedited materials, some of which are sexually explicit or may be offensive to some people. Customers access such materials at their own risk. VSNL has no control over and accepts no responsibility whatsoever for such materials.

 

The subscriber is required to ensure that objectionable or obscene messages or communications, which are inconsistent with the established laws of the country, are not made by him or any other person on the web server or web space of the subscriber.

 

The service is provided on an "AS IS and AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to warranties of title, non-infringement or implied warranties of merchantability of fitness for a particular purpose.

 

No advice or information given by VSNL, its affiliates or their respective employees shall create a warranty. Neither VSNL nor its affiliates warrants that the service will be interrupted or error free or that any information, software or other material accessible on the service is free of viruses, worms, Trojan horses or other harmful components.

 

Under no circumstances shall VSNL, its affiliates or its contractors be liable for any direct, indirect, incidental, special, punitive or consequential damages that result in any way from customers, use of or inability to use the service or to access the Internet or any part thereof, or customers reliance on or use of information, services or merchandise provided on or through the service, or that result from mistakes, omissions, interruptions, deletion of files, errors, defects, delays in operation, or transmission, or any failure of performance.

 

Payment of bills

It would be the responsibility of subscriber to make advance payment of Gateway Internet Access Services. VSNL would disconnect the service in case of non-receipt of advance payment without giving any notice to the subscriber.

 

Disclaimer

While every effort is made by VSNL to provide highest quality of services to its customers of Gateway Internet Access Services (Dial – up services, Leased line services and dedicated dial-up services) the customer acknowledges that the linking, quality and speed of data transmission of the customer with VSNL network is entirely dependant on the telephone lines connectivity as may be permitted by MTNL/DoT systems. Accordingly, VSNL shall in no event be responsible to the customer in any manner whatsoever for any failure, defect, delay in connectivity or accidental loss of connectivity of the customer with VSNL network computer or the deficiency in data transmission between the customer and VSNL network computers, or for any inconvenience, damage or loss that may be caused to any one or of any kind arising therefrom.

 
Arbitration of Disputes

In the event of any question, dispute or difference arising out of provisions of Gateway Internet Access Services, the matter shall be referred to the sole arbitration of the Chairman and Managing Director, Videsh Sanchar Nigam Limited, Mumbai.
